There are 3 ways to change your trial date, also called an adjournment.
If a first trial date has been set and has not been changed previously, you must go to the court office to request an adjournment. Complete the request form and bring it to the prosecutor’s office to get approval before the clerk can assign a new date.
If you’ve changed a trial date already, you can request an adjournment for the next trial date at least 5 days before you’re scheduled to appear in court. Visit the courthouse in person to file a notice of motion and a supporting affidavit. Bring it to the prosecutor’s office to get approval before the clerk can assign a new date.
If you’re unable to change your trial date using the first 2 options, you must attend your trial date, either in person or virtually, to request the adjournment. Or an authorized representative can attend in your place.
If you missed a trial date or an early resolution meeting through no fault of your own, you can apply to reopen your case within 15 days of the conviction date.
Submit the reopening application in person at the Provincial Offences Court in Mississauga. Call 905‑615‑4500 within 15 to 30 days to find out if your request has been granted or denied.
If you’ve gone to trial for a provincial offence and been found guilty, you must pay your fine. You can also file an appeal or apply for an extension of time to pay your fine.
You can request to a higher court to review the decision made at your trial. You must pay your fine at the Provincial Offences Court in Mississauga before completing a notice of appeal within 30 days of the conviction. This process must be done in person. Appeals will not be accepted after 4 p.m.
Once you have received your appeal date for your provincial offence, it will be heard by the Ontario Court of Justice in Brampton. For more information on the appeals process, review the Ontario Court of Justice’s guide to appeals in provincial offences cases.
If you need more time to pay your fine, you can request an extension. Submit an extension of time to pay your fine application in person at the Provincial Offences Court in Mississauga. Call 905‑615‑4500 within 15 to 30 days to find out if your request has been granted or denied.
